GUN REGULATION AND INCREASED VIOLENCE IN THE UNITED STATES

Abstract

As of September 17, 1787, the United States has based its legal and political system on the Constitution of the United States of America. Throughout the country’s history, the Constitution has been the basis for enactment of many laws and regulations. Due in part to a dramatic increase in gun violence in recent years, the Second Amendment to the Constitution has been the subject of great debate among citizens, special interest groups and all three branches of state and federal governments. The Second Amendment is contained in the Bill of Rights—the first ten amendments to the Constitution—and ratified in 1791. The Second Amendment states, “A well-regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed” (U.S. Const. amend. II). The Second Amendment is one of the most well-known amendments of the Constitution for the past 230 years. However, opinions differ as to its purpose. Some Americans believe this right should remain as it is currently interpreted by the U.S. Supreme Court, while others believe it should be stripped away due to the increase in gun violence within the country, creating a vast amount of controversy. This current issue for the country raises tough questions that remain unanswered. Most importantly, what is the turning point in which Americans will take a stand and increase gun safety regulations? This article attempts to answer that question.
