In this paper for the California Law Review, Hannah Bloch-Wehba, associate professor of law at Texas A&M University, examines the under-appreciated transparency costs associated with the erosion of Fourth Amendment doctrine that has allowed law enforcement agencies to avoid disclosure of their surveillance technologies and techniques.
